Wire Fraud

The elements of wire fraud under 18 U.S.C. § 1343 are (1) intentional participation in a scheme to defraud and (2) use of the interstate wires in furtherance of the scheme. The "scheme or artifice to defraud" and "for the purpose of executing" language in both the mail fraud and wire fraud statutes are construed identically for purposes of the government’s burden of proof and sufficiency of evidence.
